Terms of Service
Last updated: 29 October 2026
The short version
These are the rules between you and us. You must be an adult. Your entries stay yours; we process them to run the service and, beyond that, only as nameless, aggregated patterns. Credits buy actions, and Paddle handles the money. brainDiverse shows you patterns, with no guarantees — it is not medical advice, and your decisions stay yours. Break the rules and we can close your account. The detail follows, in plain words.
1. Who you’re dealing with
brainDiverse is run by Yaletown Software Inc., a company incorporated in Alberta, Canada. Contact: support@braindiverse.com. Legal notices: legal@braindiverse.com. Mailing address: on our Contact page.
These Terms, together with our Privacy Policy and Refund Policy, are a contract between you and Yaletown Software Inc. By creating an account or using brainDiverse, you accept them.
2. Who can use it
- You must be 18 or older.
- One account per person, and it’s yours alone. Keep your sign-in to yourself; what happens under your account is your responsibility.
- Give us true information about yourself when you sign up.
If we learn an account holder is under 18, we close the account, delete its data, and refund unspent credits to whoever paid for them.
3. What brainDiverse is — and is not
brainDiverse is a pattern-recognition and self-reflection tool. It finds patterns in what you record and matches them with your own past and, anonymously, with other people’s patterns.
It is not medical advice, therapy, diagnosis or treatment, and we are not a health-care provider. Nothing it shows you is a recommendation to act. Decisions about your health and your life are yours, made with your own judgment and, where needed, a qualified professional.
DSM-5 and ICD-11. To put patterns in common terms, brainDiverse may compare what you record against recognised clinical frameworks such as the DSM-5 and the ICD-11. You may be shown a category or condition name, or a topic to raise with a professional. Anything of that kind is the tool’s own guess from your words — not a diagnosis. Only a qualified clinician who assesses you directly can diagnose a condition; nothing brainDiverse produces is one, however clinical it sounds. Treat it as a prompt to reflect or to seek proper advice, never as a finding about you.
brainDiverse is not an emergency service. If you are in crisis, contact your local emergency number or a crisis line.
4. Your entries
Your entries are yours. You keep ownership of everything you record.
You give us permission (a licence) to store and process your entries — transcribe, analyze, fingerprint, match and explain — to run the service for you, and to use de-identified, aggregated patterns as the Privacy Policy describes. That permission ends when your content is deleted; what survives deletion as permanently nameless data is described in the Privacy Policy, Section 9.
You’re responsible for what you record, including what you write about other people. Entries about others are your own observations; for your own minor children, you record as their parent or guardian.
External AI chats. brainDiverse lets you take your content to an outside AI (such as ChatGPT or Gemini) and paste its response back. The trip out is yours: you use that service under your own account, under its terms and its privacy rules — we can’t see or control what it keeps or trains on. Whatever you paste back, you confirm you have the right to share with us; it then becomes one of your entries — charged, stored, fingerprinted and matched like any other, on your responsibility. Outside AIs aren’t part of brainDiverse, and we don’t check or stand behind what they produce.
brainDiverse itself. The software, the design, the name and the way it presents patterns belong to Yaletown Software Inc. Using the service gives you a licence to use it, not ownership of any part of it.
5. Credits and payments
Actions in brainDiverse cost credits. What each action costs, and what credits cost, is shown on our Pricing page. Prices can change; credits already in your wallet keep working.
- Credits never expire.
- Credits are a prepayment for use of the service. They are not money, have no cash value, and can’t be transferred — except through gift codes we issue.
- Purchases are processed by Paddle, our merchant of record. When you buy, your purchase contract is with Paddle, and Paddle’s Checkout Buyer Terms also apply.
- The free tier is a welcome gift with fixed caps. We may change it at any time; what you’ve already received stays received.
6. Refunds
The short rule: unused credits are refundable within 14 days of purchase; spent credits are final. The full rules — including gift codes and subscriptions — are in our Refund Policy. A refund automatically takes back the unspent credits it paid for, cancels an unused gift code it bought, and ends a subscription it covered.
7. Gift codes and promo codes
Codes follow the rules shown with them: how many times they work, per-person limits, and start and end dates. A refunded gift code stops working. Codes gained by abuse — fake accounts, automation, exploiting a bug — can be cancelled, along with the credits they granted.
8. Professionals
Counsellors, psychologists and other professionals may use brainDiverse in their work through a professional subscription. If you do, your clients are your clients: getting their consent and meeting your professional duties is your responsibility, not ours. brainDiverse is a tool you use; it is not us providing care to anyone.
9. The rules
Don’t:
- Break the law, or use brainDiverse to harm anyone.
- Try to work out who is behind any match, pattern or cohort. De-anonymizing other users is the gravest breach of these Terms.
- Copy, scrape, probe or reverse-engineer the service, or flood it with automated traffic.
- Abuse the free tier or codes with fake accounts.
- Share your account or resell access.
10. No guarantees
brainDiverse is a living research instrument, not an oracle. The patterns, matches and explanations it produces are findings, built from what other people reported about themselves — and findings can be wrong, incomplete, out of date, or simply not true for you.
So, to the fullest extent the law allows, we guarantee nothing about the output: not accuracy, not completeness, not fitness for your situation, not any result from acting on it. The service is provided as it is, as available — we may change, add or remove features, and sometimes it will be down. You pay for the instrument’s work, not for its answers being right. Use your own judgment on everything it shows you.
11. Ending the relationship
You can stop any time: delete your account, and the Privacy Policy says what happens to your data. If you leave, unspent credits outside the 14-day refund window are not paid out — use them first, or claim the refund in time.
We can suspend or close an account that breaks these Terms. If we ever close your account through no fault of yours, we refund your unspent credits. If we close it for fraud or abuse, we may not.
12. Our liability
To the extent the law allows: we are not liable for indirect losses — lost profits, lost opportunities, or the consequences of decisions you make from what the service shows you — and our total liability to you is capped at the amount you paid for the service in the 12 months before the claim. Nothing in these Terms removes rights that consumer law gives you and that can’t be waived.
13. Changes to these Terms
We can update these Terms. We post the new version here with its date and flag meaningful changes in the app. Using brainDiverse after a change means you accept it; if you don’t accept it, stop using the service and delete your account.
14. Governing law and disputes
These Terms are governed by the laws of Alberta, Canada, and disputes go to the courts of Alberta — except where the consumer law of the place you live gives you rights that can’t be waived; those stay yours.
15. The small print
If a court strikes one line of these Terms, the rest still stands. Not enforcing a rule once doesn’t waive it. You can’t transfer your account or these Terms to someone else; we may transfer them to a company that takes over the service, with your protections intact. These Terms, the Privacy Policy and the Refund Policy are the whole agreement between us.
